I've been noticing for some time now no matter what I have my white balance set on that every time I upload my pictures to my gallery it always reads "cloudy" in my EXIF data. Has anyone else noticed this type of discrepancy with thier photos?

Hi All
I am on a B1 - Visa visited 4 times to USA.But last time (4th time) i over stayed for about 20 days after the i-94 expired.
Normally first 3 times they gave i-94 for 3 months, last time it is only for 2 months, so it's my mistake i haven't looked it till iam
back. All this happened in June 2009. Now i am aproved for H1 - B for the year 2010. I need to face a visa interview. In DS 156
Application, Question No 38. ( Have you ever voilated the terms of a U.S. Visa or Been unlawfully present in,........)
I am checking the option Yes. Can you all help me in this please. Does 20 days extra stay will effect my H1 - B visa or if i get
the Visa, when i go to USA on H1 - B Visa does immigration stop me. Please help me on this case. Thanks a lot for all your

Me and my husband left US on AP, which is valid until nxt year. We both were working on valid H1's until we left. We dont want to go for stamping and will use AP on our arrival at the POE. We havent applied for EAD when we left. Is it Ok for us to apply for EAD once we are back in US or is it ok to apply for H1's again once we r back. In both cases whether we go for h1 or EAD, can we start wroking rt a way or do we need approval first.

Hi All,
My LC was approved recently(PD June 2004). The location/office for which my LC was initially filed was closed recently.
My company(which has offices all over states) has another locations/Offices in the same metropolitan area.The company attorney is saying that they can use my approved LC to file my I-140(and I-485 concurrently) for another location in the same area as long as it is within commuting distance of the original location.
Was wondering if anyone knows about this?

The wages for Labor Certifications are determined by MSA(Metropolitan Statistical Area), so as long as the new location is in the same MSA, there should be no problem.

If your lawyer or you can get through to a person at BEC maybe you could get that person would agree to accept mail addressed to a specific person at the BEC, that way there would be someone to contact to check that they have it.
Obviously they wouldn't normally do that, but if someone there believes the lawyer that it was lost twice then they might take pitty.
That way you are dealing with someone rather than a black box.

This is forum for LC Sub cases. I'm on last phase of my L1B(5 years would complete on 2009) so my company a large corp evaluted my case as fit for LC Sub and applied I-140 on July 4th and 485 on July 27.
I have no status on my I-140/485 or 131 since got the Receipts. Got EAD.
Even after my FP the case also was not updated.
Question:
If you have filed your I-140 LC Sub are you seeing any progress on your file?
If yes, which date your I-140 was applied?
Was that standaline or Join filing with I-485?
Which Service center is handling your case?

Hello,
I filed 485 in July 2007 and got the 485 receipt nos for myself and wife and my daughter. Both my wife and myself got EADs too. Though i applied EAD for my daughter [who is under 4 years at the time of application], i neither received EAD reciept nor the application back. I saw in some other threads that kids under 10years are not getting EADs. Is it true?
I know some may ask why we need EADs for kids? My daughter 's I-94 is expired on Oct 10th 2007 and i applied EAD for her in july just in case though she cant work.
Any ideas?

Option 1 (epassporphoto) is good. I have used it more then once for US as well as UK visa (also my daughter's Indian Passport)
Just a few tips --
Make sure
1) you take the photo under Fluoroscent (tube) light or outdoor.
2) there is not too much shadow behind
3) the background is white (or something very light)
4) if you wear glasses, remove those
5) your face should be straight (both ears should be visible)

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....
No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.

Thanks for the quick reply. I was reading that getting approved I129 means you are cap exempt for next 6 years. As the petition for visa was filed in 2007, so according to this cap exemption should be for next 6 years i.e. 2013. Would be really nice if you can clarify this.

Attorney is correct, when the requirement is Bachelor+5yr means Bachelors should be 4yr degree, Remember there is a big difference between Bachelors degree vs Bachelor degree equivalent;)
