Hi All
I know a lot of July 2nd filers and some other who have been waiting for receipt notices...
There was an update yesterday by Mathew at www.immigration-law..that of the 800,000 applications only 400,000 have been receipted so far....May be it may take 2 more months for all the receipting updates to be done....
So everybody who is frustrated ..hang in there..have patience

10/11/2007: July VB Fiasco I-485 Receipting Delays
The USCIS has yet to release the detailed progress report on the receipting delays in terms of the numbers that have yet to be processed for receipting. The only thing people know through various private websites just indicates that there are a plenty of people who are still waiting for filing fee checks cashed or receipt notices received for the cases which were filed as early as July 2, 2007, not to mention any later cases.
We reported earlier that the USCIS had allegedly received total of 800,000 cases for the July VB fiasco cases. There is an unconfirmed report that they have completed the receipting only half way through of the total, meaning approximately 400,000. There are no sources of information to verify or confirm the figures. However, if it is correct, the USCIS has yet to process mountains of receipting workloads ahead and the filers have some additional sleepless nights which they will have to endure for a while. AMEN!

It is a commonly held myth that merely entering the US once a year is sufficient to maintain GC status. If you forsee spending significant time out of the US, you should take steps to protect your GC, such as filing for a re-entry permit. You should also consider maintaining ties to a home in the US.

I am in the middle of H1-B transfer from Comp A to Comp B.. I have an urgent question,
Company A didn't run my payroll from 11/26/07-4/11/08 because i was out of the project,since then i have had a consistent payroll no gaps, my question is
1.will that affect my H1-b transfer?
I dont think it will affect as per my knowledge, in verst case, they might ask for your 2008 W2 from the old company and I assume that you had on payroll from May to year end, so you can show that if they ask
2.will USCIS go back that far to verify my paystubs?, and
Normall they will go back to 6 months max, but be prepare to submit the Client letter to prove that you have project for next couple of years, keep in mind that if you show client letter for only few months, USCIS is will issue only for that period, it happened for couple of guys....these days proof of project is a key for transfers...good luck....

Saw it. However, if my experience with slashdot is anything to go by, we wont get any sympathy from fellow (US citizen/GC) techies there .. they have been brainwashed into believing that we actually stole their jobs ... in any case their opinion does not matter much. The only folks who count are the media and lawmakers.

Hi,
Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.
Please help!!

thanks to everyone here for the kind input, I am almost done with my GC application under NIW. Since I have a load of documents for primary evidence,
how should I arrange them and where should I mention the "table of contents" so to speak. I have a detailed cover letter also.

INS prefers or should I use the term "requires" a certain way of organizing documents using certain clips. You can search online for them. They do this because it helps in filing them the documents at their office.

Hello,
My 6 year H1 term expires on Feb-2010. I have a I-140 pending in NSC since July-2007 with no signs of movement.
Hypothetically, if my I-140 gets processed after Feb-2009 and is denied (God forbid!), then will I be able to extend my H1 visa? If so, on what basis can I do it?
I do understand that H1 can be extended only before 6 months of expiration if and only if I have a I-140 pending or approved.

These guys did not mention specifically "legal immigrants" but to me that sounds even easier since most of them possibly have decent wages and also maintain a legally sound lifestyle.

I should say, compared to H1B, the risks of benching on EAD are far lower.
But I guess there is nothing concrete to prove that you are ok without pay if you work on EAD... so it's always good that your employer pay at least the labor wage if possible.
