Thanks for your reponse Panky... I filed my I-140 cocurrently with I-485 with NSC but it got transfered to CSC ...CSC is not even publishing I-140 processing dates.. Wondering if CSC is processing I-140's... I believe that NSC and TSC has sole jursidication over I-140 adjudication.

Any word on when PP for I-140 will come to life?
USCIS said PP is suspended till 8/1 and later will analyze the situation to bring it back. The analysis is talking more than a month. It is known that they have been busy people this past month. Is the I-140 application flood effecting their analysis?

I am building a simple website by using frame in Blend 4.What i am trying to achieve here.....
applying Blend 4’s built-in TransitionEffects to FRAME by using VisualState to get smooth transitions like ripple,slide in while navigating pages like you did in http://www.kirupa.com/blend_silverlight/transition_effects.htm.
I just want to know how to apply this effects directly to FRAME? :)

I have an approved I-140 from my previous employer. Is there anyway, I can expedite my labor certification, I-140 approval and I-485 through my new employer on the basis of the previous approvals? I have a PD of jan'04. I know I retain my PD due to the I-140 but I wanted to know if there is anyway to not wait for the time it takes to get approval on LC and I-140.
no labor is position dependent not person dependent. You cannot make it go faster based on earlier 140.

Foreign nationals who have stayed in the United States after the expiration of their period of authorized stay or are present in the United States without being admitted or paroled are unlawfully present in the U.S.
If more than 180 days but less than a year of unlawful presence accrues, then the foreign national is inadmissible for three years (three year bar). Foreign nationals who are unlawfully present for one year or more are inadmissible for 10 years (10 year bar). If a foreign national has accrued unlawful presence in the United States, then they are deemed inadmissible and illegible to re-enter the U.S. for either the three year or 10 year bar from the date they leave the U.S.
There is a waiver available for the unlawful presence ground of inadmissibility. Essentially the waiver will waive the three and 10 year bar of inadmissibility. The waiver is only available to foreign nationals with a U.S. citizen or lawful permanent resident (LPR) spouse or parent. Children are not deemed qualifying relatives for the waiver. The first step in the waiver process is for the foreign national to attend an immigrant visa consular interview in their home country. Once the consular officer deems the foreign national is inadmissible and a waiver is available, the foreign national will then file the waiver (form I-601, with the applicable filing fee) and establish there is extreme hardship to the U.S. citizen or LPR spouse or parent if the foreign national were not allowed to return to the United States. The waiver request is discretionary and extreme hardship is only one factor the officer will consider.
Certain individuals do not accrue unlawful presence and are not subject to the three or 10 year bar. For instance, foreign nationals under 18 years of age do not accrue unlawful presence.

It is my guess that USCIS will take the finger printing records that they have in file when we filed 485 and approve the future EAD's.
I am on the same boat. I applied on May 9, recd a receipt dated May 11 and no additional info after that.

As a practical matter, you probably want to file your wife's I-485 application as soon as possible after the first day of the month in which your PD becomes current. As you know from experience, PD's can and do retrogress dramatically with little or no notice.
If your wife is in H4 status on the date that your GC is approve, she will automatically fall out of status. She can remain out of status for up to 180 days without losing eligibility to file for AOS, but if the PD retrogresses before she files, she has to wait and hope that your PD becomes current before 180 days have passed.
If your wife changes status to E-3 she can still file her I-485 when your PD becomes current. But,
E-3 status, unlike H-1 status, requires non-immigrant intent. So, theoretically, if your wife changes to E-3 status and then files the I-485 within 60 days, an allegation of immigration fraud could be made and possibly result in denial of her I-485.

Hi,
Apologies for any inconvenience caused by this thread.
Does 1 require a UK Visa if they are travelling on British Airways? As i have my parents travelling from India to USA on British Airways(they have Multiple B1/B2 US Visa)..
Spoke to BA &they advised me to speak to UK Consulate.:(
Any info be helpful.

You need a UK Transit Visa only if you don't have a valid USA VISA stamped in the passport.
My Parents always use BA, and they never take a UK transit visa.
But if i use BA to visit India, in the near future i would be taking a transit visa, as my H1 Visa on the passport has expired (Using H1 Extension Approval right now)

Just a question.......... I just got my receipts for my 485. When I checked the receipt number on uscis it says that an approval notice for the ead was sent out 2 days ago. Any idea how long it takes to actually get the card??

My Husband�s priority date is Oct 2003 (EB3). My Employer is willing to start for GC in EB2. Can We use my husband�s EB3 Oct 2003 priority date ?

Priority Date - March 2004,
Received Date - July 2nd, 2007
Notice Date - Aug. 08, 2007
My Kid's case has
Priority Date - March 2004,
Received Date - July 2nd, 2007
Notice Date - Nov. 20, 2007 (As 08/23/2007 is the current processing time frame, my kid's Notice Date is out of current time frame)
This is happened due to a rejection of my kid's 485 application initially during July 2007 fiasco due to the Old and New fee schedule implementaion of USCIS, even though we have remitted the correct fee.
1) Do anybody know how USCIS will process our case?
Like adjudicating my and spouse applications with out kid's applicaiton? Or none of the applications process?
2) Taking an info pass appointment will do any favour on this case?
3) Any other suggestions?
